These Terms and Conditions ("Terms") govern the use of the Meat and Grill online ordering platform and WhatsApp Business ordering service operated by Meat and Grill, a duly registered business in Zimbabwe with its principal place of business at No.1 Schilder Drive / 33km peg, Mutare Road, Melfort, Zimbabwe ("Merchant," "we," "us," or "our"). Company Registration Number: 2242/2005. Melfort Meat & Grill operates as a subsidiary of Mauriberg Investments (Private) Limited
By accessing our website at melfortgrill.co.zw, using our automated WhatsApp Business checkout bot (+263 77 163 2727), or placing an order through any of our digital channels, you ("Customer," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms.
All payment transactions are processed exclusively through our authorized payment gateway provider and banking acquirer, Ecobank Ltd. or such other reputable third-party bank aggregator/acquirer as may be designated from time to time ("Payment Processor"). The Merchant does not directly process, store, or transmit any cardholder data.
The Merchant fully complies with the operating regulations of Visa International and Mastercard Worldwide. All card transactions are processed in accordance with the applicable scheme rules. The Merchant's identity is clearly disclosed as "Meat and Grill," and our physical location in Zimbabwe is as stated above. Card acceptance marks displayed on our platform indicate our authorization to accept such payment methods through our Payment Processor.
The Merchant maintains strict compliance with the Payment Card Industry Data Security Standard (PCI-DSS). Please note that we never store, log, or retain any cardholder data, including but not limited to card numbers, CVV codes, or expiration dates. No card data is stored on our servers, WhatsApp logs, or any digital systems under our control. All payment information is securely transmitted through our Payment Processor's encrypted channels and is subject to their PCI-DSS compliant infrastructure.
Transactions may be processed in United States Dollars (USD) or Zimbabwean Gold (ZiG), subject to the Payment Processor's capabilities and regulatory requirements. All pricing displayed on our platform will indicate the applicable currency.
While we endeavor to maintain accurate pricing, errors may occur. We reserve the right to cancel any order with an erroneous price listing upon discovery of such error, regardless of whether the order has been confirmed. In the event of a pricing error, we will promptly notify you and provide the option to re-order at the correct price or cancel with a full refund.
All transactions will be settled in the currency originally transacted. Any refunds due to the Customer will be issued to the original card/account used for payment and in the original transacted currency. The Merchant shall not be liable for any currency fluctuations or conversion differences.
Orders may be placed through our website (melfortgrill.co.zw) or automated WhatsApp Business bot. By placing an order through the WhatsApp bot, you expressly consent to these Terms and acknowledge that interactions with the automated bot constitute acceptance of your order and these Terms.
Order confirmations are sent through WhatsApp or email upon successful payment processing. Such confirmation does not constitute acceptance by the Merchant but confirms receipt of your order. The Merchant reserves the right to accept or reject any order at our sole discretion.
All estimated preparation times, delivery windows, and collection timeframes are approximations only. Factors including but not limited to ingredient availability, kitchen capacity, traffic conditions, and force majeure events may affect actual delivery times. The Merchant shall not be liable for delays in preparation or delivery.
Orders cannot be cancelled, modified, or refunded once they enter the kitchen preparation stage. We recommend reviewing your order carefully before confirmation. For cancellations requested before preparation begins, please contact us immediately through WhatsApp. Such requests are subject to approval at management discretion.
Due to the perishable nature of our food products, all complaints, returns, and refund requests must be filed within thirty (30) minutes of delivery or collection. Claims made beyond this timeframe may not be considered due to the consumable nature of our products. Any refunds issued shall be at the absolute discretion of management and processed to the original payment method in the original transacted currency.
These Terms shall be governed by and construed in accordance with the laws of Zimbabwe. Any dispute arising from or in connection with these Terms, including but not limited to disputes relating to the formation, existence, breach, termination, or validity thereof, shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
Nothing in these Terms shall be construed to exclude or limit any consumer rights granted under the Consumer Protection Act [Chapter 14:14] of Zimbabwe or any other applicable consumer protection legislation. In the event of any conflict between these Terms and statutory consumer rights, the statutory rights shall prevail.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between the parties relating to the subject matter hereof and supersede all prior discussions, negotiations, and agreements whether written or oral.
The Merchant reserves the right to amend these Terms at any time. Changes will be effective immediately upon posting to our website and will apply to orders placed after such posting. We encourage you to review this Policy periodically.
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
